TERMS OF USE

These Terms of Use govern access to and use of the platforms and services of INT.DESIGN, including the GRANDS PRIX DU DESIGN Awards, Magazine INT.DESIGN, INT.TV, the GET INSPIRED search engine, the NEWS, the events and the other services offered by INT.DESIGN.

Part I — General Terms of Use
1. Purpose and acceptance of the Terms
These Terms of Use govern access to and use of the platforms, products, services, publications, competitions, events and other activities operated or administered by Les Productions Interface Design inc. and La Médiathèque du Design inc. (collectively referred to as “INT.DESIGN”, “we”, “our” or “us”).
By accessing our platforms, creating an account, using our services or taking part in any of our activities, you acknowledge that you have read these Terms of Use and agree to be bound by them.
These Terms supplement our Privacy Policy, which describes how we collect, use, disclose, retain and protect your information.
Certain platforms, services, competitions, events or products may be subject to specific terms that supplement these Terms of Use. In the event of any inconsistency, those specific terms prevail for the service or activity concerned.
2. Definitions
For the purposes of these Terms of Use, the following terms have the meaning set out below.
Entrant
Any natural or legal person who submits an entry as part of the GRANDS PRIX DU DESIGN Awards.
Account
A user account allowing access to certain platforms, features or services of INT.DESIGN.
Content
Any text, photograph, image, illustration, video, logo, drawing, plan, document, technical sheet, company profile, project, product, news item, advertisement or other information published, transmitted or made accessible on the platforms of INT.DESIGN.
GRANDS PRIX DU DESIGN Awards
The international competition organized by La Médiathèque du Design inc.
INT.DESIGN
The platforms, products, services, publications, competitions, events and activities operated or administered by Les Productions Interface Design inc. and La Médiathèque du Design inc.
Jury
Any person invited by INT.DESIGN to evaluate entries or take part in the selection process.
Participant
Any natural or legal person who uses the platforms of INT.DESIGN or takes part in any of its activities.
Platforms
The websites, portals, applications and other digital platforms operated or administered by INT.DESIGN.
Project
Any work, product, concept, communication, creation or entry submitted as part of the GRANDS PRIX DU DESIGN Awards or another activity organized by INT.DESIGN.
Services
All products, services, competitions, events, publications and other activities offered by INT.DESIGN.
User
Any person who consults or uses the platforms of INT.DESIGN, whether or not they hold a user account.
3. Eligibility
Unless otherwise indicated, the platforms and services of INT.DESIGN are intended for persons aged 18 or over as well as for companies, organizations and other legal entities legally authorized to enter into agreements.
Certain activities may be reserved for particular categories of participants or be subject to specific eligibility criteria. These criteria are set out in the rules or documents applicable to the activity concerned.
Participants undertake to provide accurate, complete and up-to-date information, and to keep it up to date throughout their use of the platforms and services of INT.DESIGN.
INT.DESIGN reserves the right to refuse, suspend or cancel a registration or participation where it considers that these Terms of Use or the eligibility criteria are not met.
4. User account
Certain features of the platforms of INT.DESIGN require the creation of a user account.
You undertake to provide accurate, complete and up-to-date information when creating your account and to keep it up to date thereafter.
You are responsible for the confidentiality of your login credentials as well as for any activity carried out from your account.
You must inform INT.DESIGN as soon as possible if you suspect any unauthorized use of your account or any breach of its security.
INT.DESIGN may suspend, limit or close an account where it considers that these Terms of Use have not been complied with, where fraudulent use is suspected, or where this measure is necessary to ensure the security of its platforms, services or users.
5. Use of the platforms
You undertake to use the platforms and services of INT.DESIGN in accordance with applicable laws and these Terms of Use.
You remain solely responsible for the information, texts, photographs, videos, illustrations, logos, drawings, plans, documents and other content that you transmit or publish on the platforms of INT.DESIGN, in particular as part of the GRANDS PRIX DU DESIGN Awards, the NEWS, the GET INSPIRED search engine, company profiles, advertisements or any other service offered by INT.DESIGN.
You represent that you hold all the rights, licences, authorizations and consents necessary to allow their publication and use in accordance with these Terms of Use.
You also warrant that the information transmitted is accurate, complete and true to the best of your knowledge at the time of its transmission, and that the content provided does not infringe the rights of any third party, in particular with respect to intellectual property, copyright, trademarks, image rights or confidentiality.
Should any claim, formal notice, lawsuit or other proceeding be brought against INT.DESIGN in connection with content you have provided, you undertake to indemnify INT.DESIGN for the damages, costs, professional fees and other expenses reasonably incurred where such claim results from a breach of these Terms of Use.
INT.DESIGN does not systematically verify the accuracy of the information published and may, at any time, refuse, suspend, modify or remove any content that contravenes these Terms of Use, applicable laws or the rights of a third party.
You undertake in particular not to:
- use the platforms for unlawful, fraudulent or malicious purposes;
- publish false, misleading, defamatory, offensive or unlawful content;
- infringe the rights of a third party;
- compromise the operation, security or integrity of the platforms;
- attempt to access an account, system or platform without authorization;
- use automated processes to extract, reproduce or reuse the content of the platforms without the prior authorization of INT.DESIGN.
Part II — Specific terms for the GRANDS PRIX DU DESIGN Awards
6. The GRANDS PRIX DU DESIGN Awards
The GRANDS PRIX DU DESIGN Awards are organized by La Médiathèque du Design inc. in order to recognize, promote and showcase excellence in the fields of design, architecture, the built environment and the creative industries.
The competition is open to professionals, companies, organizations, manufacturers, eligible students and other eligible persons, in accordance with the eligibility criteria in effect at the time of submission of entries.
The disciplines, categories, eligibility criteria, registration periods, fees, deadlines and other applicable terms are published on the platforms of INT.DESIGN and may change from one edition to another.
By submitting an entry, the entrant acknowledges that they have read these Terms of Use as well as the requirements applicable to the chosen discipline and category.
7. Submission of entries
Entries must be submitted through the platforms designated by INT.DESIGN, within the prescribed deadlines.
The entrant is responsible for the accuracy, completeness and quality of the information, texts, photographs, images, documents and other content transmitted as part of their entry.
The entrant is also responsible for providing, at the time of submission of their entry, the files that meet the technical specifications required by INT.DESIGN, in particular the photographs, images or other visual files intended for print and digital publications.
An entry that is incomplete or does not meet the technical requirements may be refused or may not be eligible for certain publications or promotional activities.
An entry may be submitted only after payment of the applicable registration fees.
In order to ensure a fair and consistent evaluation, INT.DESIGN reserves the right to transfer an entry to another discipline or category where it considers it more appropriate. This transfer does not entail any additional fees for the entrant. Where possible, the entrant is informed of it.
The entrant may modify their entry until the submission deadline.
After the close of registration, the entrant can no longer modify their entry themselves. Any request for correction must be sent to INT.DESIGN, which may, at its discretion, make certain corrections where they are reasonably possible and do not compromise the proper conduct of the competition or the production of its publications.
The entrant is solely responsible for the accuracy of the information, credits and documents transmitted. It is their responsibility in particular to ensure the accuracy of the names of the companies, collaborators, photographers, manufacturers, clients and any other person or organization mentioned in their entry.
In order to ensure the editorial consistency of its platforms and publications, INT.DESIGN reserves the right to make minor corrections to typography, spelling, punctuation, capitalization or the presentation of names, without altering their meaning or identity.
The entrant is responsible for entering the required credits, in particular photographic credits, in the fields provided for this purpose at the time of submission. By entering them, the entrant confirms that they hold the necessary authorizations, in particular that of the photographer(s), allowing INT.DESIGN to reproduce, publish and distribute the submitted images as part of its activities, publications and communications, without additional remuneration.
The platforms of INT.DESIGN are available in French and in English, Canada’s two official languages, and the texts of entries can be consulted in both languages. The entrant may enter their texts themselves in French and in English, or use the translation offered by INT.DESIGN, which they may approve or modify before publication. The entrant remains responsible for the accuracy of their texts in both languages.
8. Registration fees
Registration fees are payable before the submission of an entry.
Registration fees are non-refundable and cannot be transferred to another edition of the GRANDS PRIX DU DESIGN Awards.
If an entrant has registered in a category that does not correspond to their project, they are invited to contact INT.DESIGN. Where the request is made before the close of registration and the project is eligible, INT.DESIGN may authorize the transfer of the entry to another category.
The entrant is responsible for completing their entry before the submission deadline. A registration that is incomplete or for which the required information, texts, photographs, images or other documents have not been transmitted within the deadlines is considered abandoned. Registration fees remain non-refundable.
The same project may be entered in one or more categories, subject to compliance with the eligibility criteria applicable to each of them. Each registration is considered a separate entry.
The first registration of a project is billed at the regular rate. Each additional category for the same project, entered within the same discipline, benefits from a 50% discount, in accordance with the pricing in effect.
Where the same firm enters several projects, the first project is billed at the regular rate. From the second project onward, a 20% discount is applied to each additional project, in accordance with the pricing in effect.
Each entry must include the minimum number of required documents and may include up to the maximum number of files indicated on the registration platform.
Unless otherwise indicated on the registration platform, each entry must include a minimum of five (5) photographs, images or other visual files and may include up to ten (10) photographs, images or other visual files. The same photograph, image or other visual file may be used in one or more categories.
9. Jury and evaluation process
Entries are evaluated by several juries made up of recognized professionals from different areas of expertise.
Evaluations are carried out individually by the jury members, according to the criteria established for each discipline and category.
As far as possible, INT.DESIGN presents entries in a way that favours an evaluation based on the quality of the project or product rather than on the identity of its authors. However, certain documents or information provided by entrants may contain the name of the company, collaborators or other elements that make it possible to identify a project. Given the nature of the projects presented and the information already publicly available, INT.DESIGN does not require the systematic removal of these mentions.
Jury members are required to act with impartiality, professionalism and confidentiality throughout the evaluation process.
Where a jury member is in a conflict-of-interest situation with respect to a project, their evaluation is not taken into account for any of the projects in the category concerned.
The Prix de l’année are awarded following a deliberation involving a committee made up of jury members. Where a committee member is in a conflict-of-interest situation with respect to one of the finalist projects, they do not take part in the deliberations of the Prix de l’année for that discipline.
The decisions of the juries and of the Prix de l’année committees are final.
10. Verification and correction of information after the announcement of certifications
Following the online announcement of the certifications, entrants are invited to verify the accuracy of the information associated with their projects, in particular the project name, the company name, the category, the credits and the other published information.
The entrant has a period of seven (7) days following this announcement to report any error or request a correction.
After this period, INT.DESIGN may, where reasonably possible, make corrections to the digital platforms.
However, corrections requested after this period cannot give rise to a modification of print publications, in particular Magazine INT.DESIGN, where it is already in production or printed.
It is the entrant’s responsibility to ensure that the information transmitted is accurate and to report any correction within the prescribed period.
11. Publication of projects and licence granted to INT.DESIGN
The entrant remains the owner of the copyright and other intellectual property rights they hold in the content submitted as part of their entry.
By submitting an entry, the entrant grants INT.DESIGN, at no additional cost, a worldwide, non-exclusive and royalty-free licence to use the submitted content for the purposes of its activities, in particular in order to:
- reproduce, publish, display, distribute and communicate the submitted content;
- use the content as part of the GRANDS PRIX DU DESIGN Awards and any related activity;
- publish the projects on the digital platforms of INT.DESIGN;
- publish the projects in Magazine INT.DESIGN, INT.TV, newsletters, social media, press releases, print or digital publications, exhibitions, conferences, galas, promotional campaigns and any other communication or promotional activity of INT.DESIGN;
- translate, adapt, lay out, correct, revise, summarize or modify the presentation of the submitted texts and content, as well as adapt the format, dimensions, resolution or quality of the photographs, images and other visual files, where necessary for their publication or distribution, while respecting the integrity of the project.
Projects that have obtained a certification may, at the entrant’s request and with the agreement of INT.DESIGN, not be published on its digital platforms.
Projects that have obtained the title of Grand Lauréat or a Prix de l’année are part of the official selection of the GRANDS PRIX DU DESIGN Awards. As such, they are published and showcased by INT.DESIGN, in particular in Magazine INT.DESIGN, on its digital platforms as well as in its activities, publications and communications.
The submitted content may remain published, archived or distributed on the platforms and in the publications of INT.DESIGN, including after the end of the edition of the competition to which it was submitted.
12. Verification, disqualification and withdrawal of a distinction
The entrant is responsible for the accuracy of the information and content submitted as part of their entry.
INT.DESIGN reserves the right to verify, at any time, the eligibility of an entrant or a project as well as the accuracy of the information provided.
INT.DESIGN may refuse, suspend, withdraw or disqualify an entry, a certification, a selection as a finalist, a distinction or a prize, before or after the announcement of the results, in particular where:
- the information provided is false, inaccurate, misleading or incomplete;
- the eligibility criteria are not met;
- the entrant does not hold the necessary rights or authorizations for the submitted content;
- fraud, attempted fraud or any other irregularity is found;
- the entrant contravenes these Terms of Use;
- any other situation is liable to compromise the integrity, fairness or reputation of the GRANDS PRIX DU DESIGN Awards or of INT.DESIGN.
Where applicable, INT.DESIGN may in particular:
- remove the entry from its digital platforms;
- withdraw the certifications, distinctions, prizes or recognitions awarded;
- deactivate the digital certificates, logos and associated promotional tools;
- update its archives, publications and communications to reflect this decision.
The decisions made by INT.DESIGN under this section are final.
13. Use of distinctions, certifications and logos
The certifications, distinctions and prizes awarded as part of the GRANDS PRIX DU DESIGN Awards are attributed to a project, a product or, in the case of the Firmes & Studios categories, to the company or studio concerned.
Entrants whose project, product or company receives a certification, distinction or prize may use the official logos and promotional tools made available to them by INT.DESIGN, in accordance with these Terms of Use and the applicable graphic standards.
The entrant is responsible for using exclusively the logo corresponding to the distinction actually obtained and only in connection with the project, product or company to which that distinction was awarded.
The official logos available in the entrant’s dashboard correspond to the distinctions obtained for each of their projects, products or companies. It is the entrant’s responsibility to ensure that they use the appropriate logo for each distinction.
Except in the case of the Firmes & Studios categories, a distinction obtained by a project or product may not be presented as a distinction awarded to the company as a whole, nor be used to promote another project, product or service.
The logos provided by INT.DESIGN may not be modified, distorted, recoloured or used in a manner likely to create confusion as to the nature of the distinction obtained.
In the event of inappropriate use of a logo, certification or distinction, INT.DESIGN may require the immediate removal of the material concerned and take any measure necessary to put an end to such use.
Part III — General provisions
14. Intellectual property
Unless otherwise indicated, the platforms, publications, services, logos, trademarks, texts, graphics, interfaces, layouts, databases and other content published or made available to the public by INT.DESIGN are protected by applicable intellectual property laws.
Except with the written authorization of INT.DESIGN, it is prohibited to reproduce, publish, distribute, modify, sell, exploit or use this content for commercial purposes.
This provision does not apply to content whose rights remain the property of entrants or other rights holders, which is used in accordance with these Terms of Use.
15. Availability of the platforms
INT.DESIGN uses reasonable means to ensure the proper functioning of its platforms and services.
However, INT.DESIGN cannot guarantee that its platforms will be accessible at all times, without interruption, error or technical failure.
INT.DESIGN may temporarily suspend access to all or part of its platforms in order to carry out maintenance work, updates, improvements or any other intervention necessary for their proper functioning.
INT.DESIGN cannot be held liable for interruptions, delays or access limitations resulting in particular from a technical problem, a network failure, a service provider, a cyberattack or any other circumstance beyond its control.
Part IV — Final provisions
16. Limitation of liability
INT.DESIGN uses reasonable means to ensure the proper functioning of its platforms, services, competitions, publications and events.
However, INT.DESIGN cannot be held liable for direct or indirect damages resulting in particular from:
- an error or omission in the information or content provided by a user, participant, entrant, advertiser or partner;
- a temporary interruption or unavailability of the platforms;
- a technical, computer or telecommunications problem beyond its control;
- the loss, corruption or unauthorized access to data attributable to a third party or to an event of force majeure;
- a delay, modification or inability to publish content, a project, a distinction or any other information.
To the extent permitted by applicable laws, the liability of INT.DESIGN, where it may be engaged, is limited to the amounts actually paid by the participant in respect of the service concerned.
17. Force majeure
INT.DESIGN cannot be held liable for the non-performance or delay in the performance of any of its obligations where such situation results from an event beyond its reasonable control, in particular an event of force majeure, a natural disaster, a pandemic, a labour dispute, a cyberattack, a major outage, an interruption of telecommunications services, a governmental decision or any other similar event.
In such a situation, INT.DESIGN may in particular postpone a deadline, temporarily suspend a service, modify the schedule of an activity, adapt the conduct of a competition or defer entries to a later edition of the GRANDS PRIX DU DESIGN Awards, without any refund being payable.
18. Changes to the Terms of Use
INT.DESIGN may amend these Terms of Use to reflect changes in its platforms, services, competitions or applicable laws.
The most recent version of these Terms of Use is published on the platforms of INT.DESIGN and takes effect upon being posted online, unless otherwise indicated.
Continued use of the platforms or participation in the activities of INT.DESIGN after the publication of an amended version of these Terms of Use constitutes acceptance of them.
19. Governing law
These Terms of Use are governed by and interpreted in accordance with the laws in force in the province of Québec and the federal laws of Canada that apply therein.
Any dispute relating to the interpretation or application of these Terms of Use falls under the jurisdiction of the courts of the judicial district of Longueuil (Québec), subject to the mandatory provisions provided by applicable laws.
